There is a new Virginia DUI case about physical control that was issued yesterday.
Virginia DUI Physical Control Case – June 30 – 2009 : DUIAttorney.com: "And just when the reader (the the edge of their seat, I'm sure) thinks that the appeals court is going to at least thrown the defendant in this case a bone… nope, not in this Virginia DUI case."
(Via DUI News.)
This is the trend in many states… basically, if you are drunk and behind the wheel, it doesn't matter if you are not driving, and in fact it doesn't matter if you are not even conscious.

Most states favor one acronym for impaired driving. For example you get a Texas DWI, but you get a California DUI, you get a New York DWI, but you get a Florida DUI.
Just as there is no difference between a "lawyer " and an "attorney," there is little difference between the common meanings of DUI and DWI.
DWI can stand for the following:
- Driving While Intoxicated
- Driving While Impaired
- Driving With Impairment
DUI typically stands for Driving Under the Influence.
On this website, we use the term DWI lawyer and DUI lawyer interchangeably. If you are charged in New York, you will typically refer to your legal representation as your DWI lawyer, and in Florida as your DUI lawyer. It really makes little difference though.
